Section 4 — E-Commerce Platform

Our store is hosted on GoHighLevel, which provides us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through GoHighLevel's secure data storage, databases, and the general GoHighLevel application, behind a firewall.

Payment: If you choose a direct payment gateway to complete your purchase, your credit card data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as necessary to complete your transaction. After that, your transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Section 5 — Third-Party Services

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. Program Description

Baseline Performance offers a recurring mobile messaging program (the "Program") that sends transactional and marketing text messages, including order updates, shipping notifications, promotions, cart reminders, product launches, and customer service alerts. By providing your mobile number and opting in, you expressly consent to receive such messages from Baseline Performance at the number provided, including messages sent using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice, where applicable.

Consent Is Not a Condition of Purchase

Your consent to receive marketing text messages is NOT a condition of purchasing any goods or services from Baseline Performance. You may purchase our products without opting in to the Program.

One-to-One Consent (FCC 2024 Rule)

Consent obtained through any Baseline Performance web form, pop-up, checkout, or lead form applies only to Baseline Performance and is not shared with, sold to, or transferred to any third-party marketer, affiliate, partner, or seller. Each consent is specific to Baseline Performance as a single identified seller, consistent with the FCC's 2024 one-to-one consent rule under the TCPA.

Message Frequency & Rates

Message frequency varies and may include up to 10 messages per month. Message and data rates may apply. Baseline Performance and the mobile carriers are not liable for delayed or undelivered messages.

Eligibility & Disclosure

You must be at least 18 years old and the account holder or authorized user of the mobile number you provide. Baseline Performance will not sell, rent, loan, trade, or transfer any phone number or customer information collected through the Program to any third party for their marketing purposes.

Email Marketing — Opt-In Consent (CAN-SPAM Act)

By submitting your email address through any Baseline Performance web form, checkout, pop-up, lead magnet, or account registration and checking the associated opt-in box, you expressly consent to receive commercial and transactional emails from Baseline Performance, including newsletters, promotions, new product announcements, educational content, order confirmations, shipping notifications, and customer service messages.

Your consent is not a condition of purchasing any goods or services. You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link included in every marketing email, by emailing [email protected] with the subject line "UNSUBSCRIBE," or by writing to us at the postal address below. Unsubscribe requests will be honored within ten (10) business days as required by the CAN-SPAM Act. Every marketing email we send will include: (i) a clear and conspicuous identification that the message is an advertisement; (ii) our valid physical postal address; (iii) a working unsubscribe mechanism; and (iv) a non-deceptive subject line and "From" line that accurately identifies Baseline Performance as the sender.

Baseline Performance collects the following categories of personal information: identifiers (name, email, phone, postal address, IP address); commercial information (purchase history, products viewed); internet activity (browsing, cookies, pixels); geolocation (general location from IP); payment information (processed by PCI-DSS compliant gateway); and inferences drawn from the above to build a consumer profile. We collect this information to fulfill orders, provide customer service, market our products, improve our website, prevent fraud, and comply with law. Baseline Performance honors the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sale or sharing of personal information for visitors from states that require it.

Shine the Light (California)

Children's Privacy (COPPA)

Baseline Performance's website and services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. Data Retention, Security & Breach Notification

Order records are typically retained for seven (7) years for tax purposes. Marketing consents are retained for as long as you remain opted in, plus a reasonable period to demonstrate compliance.

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including TLS/SSL encryption in transit, AES-256 encryption at rest for sensitive fields, PCI-DSS compliant payment processing, role-based access controls, and regular security reviews. No method of transmission over the internet is 100% secure.
